These Terms of Service ("Terms") govern your use of lit-fusion.com, the Lit-Fusion platform at app.litfusion.co, and related services (together, the "Service"), provided by LITTMAN LLC, doing business as Lit-Fusion ("Lit-Fusion", "we", "us"). By using the Service, you agree to these Terms.

1. The Service

Lit-Fusion provides sales and marketing software, including CRM, forms, booking, email and text messaging, invoicing, and reporting tools, along with related setup and support services.

2. Accounts

You must give accurate information when you create an account and keep your login details secure. You are responsible for activity under your account.

3. Payments

Paid plans are billed as described on our pricing page or in your order. Fees are non-refundable except where required by law or stated in writing by us.

4. Acceptable Use

You agree not to use the Service to send spam or unsolicited messages, break any law (including laws about calls, texts, and email such as the TCPA and CAN-SPAM), or contact people without the consent the law requires. You are responsible for getting and keeping proper consent from your own contacts before you message them through the Service. We may suspend accounts that break these rules.

5. Communications From Us

We may email you about your account, billing, and service changes. Marketing emails and text messages are sent only if you opt in. You can unsubscribe from marketing emails at any time with the link in each email, and opt out of texts by replying STOP.

6. SMS Terms

Program: Lit-Fusion text messages.

What you will receive: demo and appointment confirmations and reminders, replies to your inquiries, account and support notices, and occasional updates about Lit-Fusion services.

How you join: by checking the text message consent box on one of our website forms. Consent is optional and is not a condition of any purchase or of booking a demo.

Message frequency varies.

Message and data rates may apply.

To stop: reply STOP at any time. You will receive one final message confirming you are unsubscribed.

Carriers are not liable for delayed or undelivered messages.

Your information is handled as described in our Privacy Policy at lit-fusion.com/privacy-policy. We do not share your mobile number or text messaging consent with third parties for their marketing.

You keep ownership of the data and content you put into the Service. You give us permission to host and process it only to provide the Service to you.

8. Intellectual Property

The Service, its software, design, and content (other than your content) belong to Lit-Fusion and its licensors.

9. Termination

You may stop using the Service at any time. We may suspend or end your access if you break these Terms or misuse the Service.

10. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent allowed by law, Lit-Fusion is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA.

12. Changes

We may update these Terms. The updated version will show a new effective date on this page.
